Welcome to audio-marks! These Terms of Service ("Terms") govern your use of the audio-marks app (the "App"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Overview

audio-marks allows users to create bookmarks for audiobooks while listening in the Apple Music app. The App may also support Spotify integration in the future, subject to approval from Spotify.

We are not affiliated with Apple or Spotify, and this App simply interacts with their publicly available APIs to provide functionality.

2. Usage and License

• The App is licensed, not sold to you under Apple's standard End User License Agreement (EULA).
• You may use the App only for personal, non-commercial purposes.
• You may not modify, reverse-engineer, or misuse the App.

3. Spotify Integration Disclaimer

• Spotify integration is not guaranteed. We have applied for API access, but Spotify may deny approval for any reason.
• If approval is denied, Spotify-related features will not be available.
• If Spotify imposes restrictions that prevent selling Spotify-related features, these features (if implemented) may be provided for free.

We will notify users who have signed up for email updates if and when Spotify support is available.

4. Payments and Access

• The App is free to use for 7 days without registration.
• After the trial, full access requires a one-time in-app purchase (€2.39).
• All payments are processed by Apple’s App Store. We do not handle or store payment information.
• No refunds beyond what is allowed by Apple’s policies.

5. Data Privacy

• We do not collect personal data beyond email addresses for the Spotify waiting list (if voluntarily provided).
• Audio-marks (bookmarks) are stored locally on your device and are not shared with us or any third party.
• Our Privacy Policy outlines how we handle data.

6. Third-Party Services

The App interacts with third-party services:

• Apple Music API – Required for creating and resuming audio-marks in Apple Music.
• Spotify API (if approved) – Potentially used for Spotify integration.

These services may change their policies or restrict access at any time, affecting the App's functionality. We are not responsible for any changes made by Apple or Spotify that impact the App.

You are responsible for complying with Apple Music’s and Spotify’s terms:

7. Limitation of Liability

We provide the App "as is" without warranties. We are not responsible for:

• Service disruptions caused by Apple Music or Spotify.
• Loss of audio-marks due to device issues or app updates.
• Incompatibility with future changes in Apple’s or Spotify’s APIs.

Use the App at your own risk.

8. Changes to These Terms

We may update these Terms from time to time. Updates will be posted within the App and on our website. Continued use of the App after changes means you accept the new Terms.
